BY DOWNLOADING THE ROUTES APP, YOU AGREE TO THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS DO NOT DOWNLOAD OR USE THE APP.
1.1 CV Technologies Limited (trading as Routes) of Wigan Hall, New Market Street, Wigan, WN1 1HH, United Kingdom (company number - 13785993) (hereafter referred to as “we”, “us” and/or “our”) license you to use, as permitted in these Terms:
1.1.1 the Routes mobile application software, any data supplied with the software, and any updates or supplements to it (the “App”);
1.1.2 the related online / electronic documentation, where applicable, including any template documentation such as curriculum vitae (CV) templates and associated material (the “Documentation”); and
1.1.3 the service you connect to via the App and the content we provide to you through it (the “Service”). As part of the Service, you shall be permitted to upload video content to your CV strictly in accordance with these Terms, including clause 6.2.4.
2. YOUR PRIVACY
2.1 We only use any personal data we collect through your use of the App, the Documentation and the Service in the ways set out in our privacy policy. By using the App and the Service, you consent to such use of your personal data and you warrant that all data provided by you is accurate and correct.
2.2 The App has been developed using native technologies of iOS and Android platforms in order to provide a robust user experience. Please note that the App uses serverless technologies and cloud computing so your data is not stored locally on our system.
2.3 Please be aware that internet transmissions are never completely private or secure and that any message or information you send using the App and/or the Service may be read or intercepted by others, even if there is a special notice that a particular transmission is encrypted.
3. APP STORE TERMS ALSO APPLY
3.1 The ways in which you can downland and use the App may also be controlled by the terms and conditions and polices of the Google Play Store and/or the Apple App Store so you should read these carefully and ensure you comply with them before downloading the App.
3.2 We have no responsibility for any terms, conditions and policies of the Google Play Store and/or the Apple App Store. If you have queries and/or complaints regarding such terms, conditions and policies, you should contact Apple or Google accordingly.
4. OPERATING SYSTEM REQUIREMENTS
4.1 The App requires a mobile telephone or handheld device with a minimum of 1GB of memory and the iOS 11 or Android 9 operating system.
4.2 The App will always work with the current or previous version of the operating system (as it may be updated from time to time) and match the description of it provided to you when you downloaded it.
5. SUPPORT FOR THE APP AND HOW TO TELL US ABOUT PROBLEMS
5.1 If you want to learn more about the App or have any problems using the App, please take a look at our support resources at - https://routes-app.com/support.
5.2 If you think the App is faulty or misdescribed or wish to contact us for any other reason please email our customer service team at - support@routes-app.com.
5.3 If we have to contact you we will do so by email, by SMS or by pre-paid post, using the contact details you have provided to us.
6. HOW YOU MAY USE THE APP
6.1 You must be aged 16 or over to accept these Terms and download the App.
6.2 In return for your agreement to comply with these Terms you may:
6.2.1 download a copy of the App onto your devices and view, use and display the App and the Service on such devices for your personal purposes only;
6.2.2 use any Documentation to support your permitted use of the App and the Service;
6.2.3 receive and use any free supplementary software code or update of the App incorporating "patches" and corrections of errors as we may provide to you; and
6.2.4 upload video content to the App as part of your CV up to a maximum of 1GB.
6.3 From time to time we may automatically update the App and change the Service to improve performance, enhance functionality, reflect changes to the operating system or address security issues. Alternatively, we may ask you to update the App for these reasons. If you choose not to install such updates or if you opt out of automatic updates you may not be able to continue using the App and the Service.
6.4 If you download the App onto any mobile telephone or other device not owned by you, you must have the owner's permission to do so. You will be responsible for complying with these Terms, whether or not you own the telephone or other device.
6.5 In addition, you acknowledge and agree that your access to and use of the App is subject to a ‘Subscription Agreement’ between us and the relevant organisation. Further, you consent that such organisation will see any content which you upload to the App.
7. ACCEPTABLE USE RESTRICTIONS
7.1 You agree that you will:
7.1.1 not rent, lease, sub-license, loan, provide, or otherwise make available, the App, the Service and/or the Documentation in any form, in whole or in part to any person without prior written consent from us. For the avoidance of doubt, the App, the Documentation and the Service are made available for your personal use only and you must not use any part of the App, the Documentation and/or the Service for commercial purposes;
7.1.1 not copy the App, Documentation or Service, except as part of the normal use of the App or where it is necessary for the purpose of back-up or operational security;
7.1.3 not translate, merge, adapt, vary, alter or modify, the whole or any part of the App, the Documentation or the Service nor permit the App, the Documentation or the Service or any part of them to be combined with, or become incorporated in, any other programs, except as necessary to use the App, the Documentation and/or the Service on devices as permitted in accordance with these Terms;
7.1.4 comply with all applicable technology control or export laws and regulations that apply to the technology used or supported by the App or any Service;
7.1.5 not disassemble, de-compile, reverse engineer or create derivative works based on the whole or any part of the App, the Documentation or the Service nor attempt to do any such things, except to the extent that (by virtue of sections 50B and 296A of the Copyright, Designs and Patents Act 1988) such actions cannot be prohibited because they are necessary to decompile the App to obtain the information necessary to create an independent program that can be operated with the App or with another program (“Permitted Objective”), and provided that the information obtained by you during such activities:
is not disclosed or communicated without our prior written consent to any third party to whom it is not necessary to disclose or communicate it in order to achieve the Permitted Objective;
is not used to create any software that is substantially similar in its expression to the App;
is kept secure; and
is used only for the Permitted Objective.
7.2 Further, you must:
7.2.1 not use the App, the Documentation and/or the Service in any unlawful manner, for any unlawful purpose, or in any manner inconsistent with these Terms, or act fraudulently or maliciously, for example, by hacking into or inserting malicious code, such as viruses, or harmful data, into the App, the Service or any operating system;
7.2.2 not infringe our intellectual property rights or those of any third party in relation to your use of the App, the Documentation and/or Service, including by the submission of any material (to the extent that such use is not licensed by these Terms);
7.2.3 not transmit any material that is defamatory, offensive or otherwise objectionable in relation to your use of the App, the Documentation and/or the Service;
7.2.4 not use the App and/or the Service in a way that could damage, disable, overburden, impair or compromise our systems or security or interfere with other users; and
7.2.5 not collect or harvest any information or data from the App and/or any Service or our systems or attempt to decipher any transmissions to or from the servers running the App and/or the Service.
8. WE MAY COLLECT TECHNICAL DATA AND LOCATION DATA ABOUT YOUR DEVICE
8.1 By using the App and/or the Service, you agree to us collecting and using technical information about the devices you use the App on and related software, hardware and peripherals to improve our products and to provide the App and our Service to you.
8.2 The App will likely make use of location data sent from your device. You can turn off this functionality at any time by turning off the location services settings for the App on your device. If you use these location services settings, you consent to us and where applicable, our licensees' transmission, collection, retention, maintenance, processing and use of your location data to provide and improve the App and the Service.
8.3 You may stop us collecting such data at any time by turning off the location services settings on your device.
9. WE ARE NOT RESPONSIBLE FOR OTHER WEBSITES YOU LINK TO
9.1 The App and/or the Service may contain links to other independent websites which are not provided by us. Such independent sites are not under our control, and we are not responsible for and have not checked and approved their content or their privacy policies (if any).
9.2 You will need to make your own independent judgement about whether to use any such independent sites, including whether to buy any products or services offered by them.
10. INTELLECTUAL PROPERTY RIGHTS
10.1 All intellectual property rights, including copyright, design rights, patents, inventions, know-how, database rights, trade marks, source codes and any other intellectual property rights in the App, the Documentation and the Service, howsoever rising throughout the world, whether or not in the future, belong to us (or where applicable, our licensors) and the rights in the App, the Documentation and the Service are licensed (not sold) to you. You have no intellectual property rights in, or to, the App, the Documentation and/or the Service other than the right to use them in accordance with these Terms.
10.2 All trade names, trade marks, service marks and other product and service names and logos displayed on the App, the Documentation and/or in any material used in connection with the Service from time to time are our property or the property of their respective owners and are protected by applicable trade mark and copyright laws. These marks may be registered or unregistered marks of CV Technologies Limited or others.
10.3 Nothing contained on the App, the Documentation and/or used in connection with the Service should be construed as granting any licence or right of use of any person's or entity's trade mark (whether registered or unregistered) which is displayed thereon without their express permission. Further you may not remove, change or obscure the ‘Routes’ logo or any notices of proprietary rights on any part of the App, the Documentation and/or the Service.
11. OUR RESPONSIBILITY FOR LOSS OR DAMAGE SUFFERED BY YOU
11.1 We are responsible to you for foreseeable loss and damage caused by us. If we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaching these Terms or our failing to use reasonable skill and care. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time you accepted these Terms, both we and you were aware it might happen. For the avoidance of doubt, we are not responsible for any loss or damage that is not foreseeable. In this regard, the App, the Documentation and the Service are made available to you only as a tool to create your CV and we make no representations, warranties or guarantees, whether express or implied, regarding the outcome of your use of the App, including as to the standard, specification and/or quality of any CV generated through your use of the App, the Documentation and/or the Service.
11.2 We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors or for fraud or fraudulent misrepresentation.
11.3 If defective digital content that we have supplied damages a device or digital content belonging to you, we will either repair the damage or pay you appropriate compensation. However, we will not be liable for damage that you could have avoided by following our advice to apply an update offered to you free of charge or for damage that was caused by you failing to correctly follow installation instructions or to have in place the minimum system requirements advised by us.
11.4 We are not liable for business losses. As set out in clause 7.1.1, the App is for personal use only. If you use the App for any commercial, business or resale purpose we will have no liability to you whatsoever for any loss of profit, loss of business, business interruption, or loss of business opportunity.
11.5 The App, the Documentation and the Service are provided for general information purposes only. They do not offer advice on which you should rely. You must obtain professional and/or specialist advice before taking, or refraining from, any action on the basis of information obtained from the App, the Documentation and/or the Service, including any template CVs and associated material. Although we make reasonable efforts to update the information provided by the App, the Documentation and the Service, we make no representations, warranties or guarantees, whether express or implied, that such information is accurate, complete or up to date and/or that any templates and associated material provided by us (including any CV) will in any way result in you securing a placement, engagement, any form of employment or similar (whether paid or unpaid).
11.6 Please back-up content and data used with and uploaded to the App. We recommend that you back up any content and data used in connection with the App, to protect yourself in case of problems with the App, the Documentation and/or the Service. If you fail to do so, we will have no liability to you for any lost content or data provided/uploaded via the App, including any lost CV generated through your use of the App, the Documentation and/or the Service.
11.7 Check that the App and the Service are suitable for you before you download the App. The App and the Service have not been developed to meet your individual requirements. Please check that the facilities and functions of the App and the Service (as described on the Apple App Store or the Google Play Store (as applicable)) meet your requirements.
11.8 We are not responsible for events outside our control. If our provision of the App, the Documentation or the Service and/or our support for the App, the Documentation or the Service is delayed by an event outside our control then we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay. Provided we do this we will not be liable for delays caused by the event but if there is a risk of substantial delay you may contact us to end your contract with us and where applicable, receive a refund for any Service in connection with the App which you have paid for but not received.
12. WE MAY END YOUR RIGHTS TO USE THE APP AND THE SERVICES IF YOU BREACH THESE TERMS
12.1 We may end your rights to use the App, the Documentation, and the Service at any time by contacting you if you have breached these Terms. If, in our discretion, what you have done can be put right we will give you a reasonable opportunity to do so.
12.1.1 If we end your rights to use the App, the Documentation and the Service:
12.1.2 you must stop all activities authorised by these Terms, including your use of the App, the Documentation and the Service;
12.2.3 you must delete or remove the App from all devices in your possession and immediately destroy all copies of the App which you have and confirm to us that you have done this; and
12.2.4 where possible, we may remotely access your devices and remove the App from them and cease providing you with access to the Service.
13. CHANGES TO THESE TERMS
13.1 We may need to change these Terms at any time including to reflect changes in law or best practice or to deal with additional features which we introduce.
13.2 We will give you at least 30 days’ notice of any change by sending you an SMS or email with details of the change or notifying you of a change when you next use the App.
13.3 If you do not accept the notified changes you may continue to use the App and the Service in accordance with the existing terms but certain new features may not be available to you.
14.GENERAL
14.1 References in these Terms to “include” and “including” (or any similar expression) are to be construed without limitation.
14.2 We are giving you personally the right to use the App as set out above. You may not transfer the App to someone else, whether for money, for anything else or for free. If you sell or give away any device on which the App is installed, you must remove the App from it prior to the sale or free transfer of the device.
14.3 We may transfer our rights and obligations under these Terms to another organisation on notice to you and we will ensure that such transfer will not affect your rights under these Terms.
14.4 You may not transfer your rights and obligations under these Terms to another person without our prior written consent.
14.5 These Terms do not give any rights to any person under the Contract (Rights of Third Parties) Act 1999 to enforce any term of these Terms.
14.6 If for any reason any part of these Terms is deemed unenforceable by a competent authority, then that part of the Terms will be deleted and this will not affect the validity or enforceability of the remaining terms.
14.7 No failure or delay by us to exercise any right, power or remedy under these Terms will operate as a waiver of it nor will any partial exercise preclude any further exercise of the same, or of some other right, power or remedy.
14.8 The construction, validity and performance of these Terms is governed by English law. You agree that the courts of England will have exclusive jurisdiction over any claim arising out of or in connection with these Terms.
